Thousands Complain of Complications Related to Bard Mesh

Over the last few years, the U.S. Food and Drug Administration (FDA) issued warnings about an increased risk of complications when using hernia mesh products. C.R. Bard, Inc. and others continue to make and sell surgical mesh for use in hernia repair surgery.

Severe pain near the implant site is the most common complication, but the FDA has a long list of reported complications with this type of mesh patch, including:

  • An increased risk of abdominal infections
  • Adhesion to the bowel wall
  • Bowel perforation or obstruction
  • Breaking, tearing, or disintegration of the mesh
  • Dislocation or migration of the mesh patch
  • Increased recurrence of the hernia
  • Seromas
  • Fistulae
  • Additional procedures to revise the repair or remove the patch

Davol, the Bard subsidiary, recalled several products as early as 2005. The recalls continued in 2006 and 2007. As of 2018, there are still pending lawsuits related to these recalled devices. In addition, people are now taking legal action related to several newer products, including:

  • Composix E/X Mesh
  • PerFix Plug
  • Sepramesh IP
  • Ventralex ST Hernia Patch

Recoverable Damages in a Hernia Mesh Lawsuit

The initial lawsuits against the recalled Bard mesh implant and other “first generation” mesh patches cost the manufacturers more than $1 billion in court-ordered payouts and out-of-court settlement agreements. Thousands of people held Bard liable for their potentially defective medical products.

The current generation of devices are being accused of causing many of the same complications. If we win a verdict or negotiate a settlement in your case, you may recover damages for:

  • Medical bills
  • Ongoing care costs
  • Lost wages and benefits
  • Diminished earning capacity
  • Out-of-pocket expenses
  • Loss of services
  • Pain and suffering
  • Mental anguish
